1. DISCLAIMER

CallDaTech exclusively performs all services, repair and upgrading services as is. We believe business should be conducted honestly, fairly and be subject to reasonableness. We strive to provide the highest quality of service and support. We cannot guarantee specific results for our services, but will operate under the principles stated above and expect you to do the same.


2. PAYMENT TERMS

All remote services with a one-time flat rate must click the 'Pay thru Google Checkout' button after appointment is scheduled to pay for service in advanced. If appointment is cancelled a minimum of two (2) hours in advanced per scheduled appointment, customer will be fully refunded. If appointment is cancelled less than the (2) hours per scheduled appointment, CallDaTech will refund 75% of the total service payment.

All monthly subscription will be charged an additional setup fee of $59 per each computer for the first month and afterward, the customer will be billed the monthly subscription charge. Customer must call CallDaTech at 901.590.3455 to give credit card information. CallDaTech will bill customer each month per the date customer signed up with CallDaTech's monthly subscription. If customer pay for a year, a 5% discount will be issued. All monthly subscription plans are non-refundable. If payment becomes thirty (30) past due, the total remainder of contract amount is due in full. Failure to pay may result in the debt being turned over to a collections agency and reporting to the credit bureau. You will be responsible for all costs incurred by us, collection agencies, or courts incurred by litigation for failure to pay.

An early termination fee, per the monthly subscription plans, of 75% of the remaining cost of the term will be charged to Client, as reasonable charges for liquidated damages if this Agreement is terminated before the initial term date.


3. GUARANTEE

CallDaTech has a 100% Guarantee No Fix - No Fees policy. If CallDaTech can not fix your computer problem, other options will be presented to you and you will be 100% refunded. This is only for the One-Time Computer Fix customers. If we work on your PC and find it may require for you to obtain hardware, CallDaTech will keep your service ticket open for 7 days to give you time to obtain the hardware to complete the service. If we do not hear from you within those 7 days, your ticket will be closed and you will not be refunded. CallDaTech guarantees their services for 7 days from date of orginal service.

Also, if CallDaTech's techicians are not able to connect to your PC in 15minutes, other options will be presented to you and you will be 100% refunded.


4. LIABILITY

We provide our services in an effort to fix, upgrade, or otherwise repair the computer systems for which you request such services. We will not intentionally harm your system. It is our goal to fix your computer, not damage it more. In the case of accidental damage or data loss to your system, further damage or data loss caused by already existing problems in your system such as viruses, misconfigured software, or hardware problems/failures, you agree to hold us, CallDaTech, and any persons associated with or involved in the work being done for you, non-liable for any damages resulting from such problems.

5. SERVICE AND SUPPORT

Customer satisfaction is of utmost importance to us. CallDaTech prides itself on Customer Service and Satisfaction. We realize that all customers deserve the same amount of respect. It doesn’t matter whether the customer is a novice user or an advanced user, we will try our best to discuss their computer concerns in a language on their level that they can understand and comprehend. Additional support may be provided free of charge at our discretion.

6. DESCRIPTION OF SERVICES

CallDaTech will provide to Client the following services:

* Protection Plan $11.95 per month
* Basic (one PC) Plan $12.95 per month
* Silver (up to 3 PCs) Plan $24.95 per month
* Gold (up to 4 PCs) Plan $34.95 per month

CallDaTech reserves the right to terminate this agreement at any time at CallDaTech's discretion at any time.


7. TRANSFER

Customer is able to transfer agreement to one (1) different computer per year. This is in the event the customer purchases a new computer and wants to transfer agreement to this new computer. Any additional transfers within a given year will require a one time set-up fee of $59.95 per new computer.


8. INDEMNIFICATION

Customer agrees to indemnify and hold CallDaTech harmless from all claims, losses, expenses, and/or fees including attorney fees, costs, and judgments that may be asserted against CallDaTech.


9. ENTIRE AGREEMENT

This Agreement contains the entire agreement of the parties, and there are no other promises or conditions in any other agreement whether oral or written concerning the subject matter of this Agreement. This Agreement supersedes any prior written or oral agreements between the parties.


10. GOVERNING LAW

This Agreement is governed by the laws of the State of Tennessee.
